BATTLIN’ BEARS RESTRICTIONS

The above described tract of land is conveyed subject to the following restrictive covenants that shall run with the land and shall be binding on Grantees, their heirs and assigns, and shall insure to the benefit of Grantors, Their successors and assigns and shall also insure the benefit of any successors or assigns from Grantee of any part of said land:

1. If the owner of the land shall violate any of the provisions of these restrictive covenants, any owner governed by these conditions or covenants herein shall be entitled to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants and to prevent him or them from so doing and to recover damages and attorney’s fees incurred enforcing these restrictive covenants, and /or collecting damages.

2. Any construction commenced on any Lot must be completed within one (1) year of the time construction was initiated and al buildings erected shall be of new construction, being constructed on site on the respective Lot. Modular or ready built homes or buildings are prohibited. No house trailer, mobile home, truck body, tent, shack, barn or other building (other than main residence) shall at anytime be used for dwelling purposes or for any permanent purpose, nor shall any residence of temporary character be permitted.

3. No residences shall be constructed or permitted on the above described property which does not contain at least 1400 square feet of living space. Attached garages and porches will be excluded in calculating square footage.

4. No temporary buildings shall be erected on any Lot except during actual construction of a dwelling be erected therein and then such temporary building must be on the Lot on which construction is in progress and not an adjoining Lot, street, or easement; and at completion of construction, the temporary building must be removed immediately. Developer shall be permitted to erect and use a temporary building as a sales office. No such temporary building shall be used for residential purposes.

5. The above-described property shall not be used for automobile wrecking, a junkyard, and/or storage of unregistered or inoperable automobiles or hazardous materials.

6. Sewage and waste water disposable systems shall be of a type approved or recommended by the State of Texas and at all times in proper sanitary condition.

7. All fencing shall be made with professional, workmanlike quality and be of a neat appearance.

8. Livestock will not be permitted, except Lots 28, 29, 30, 31, 32, 33 and 34. Lots 29,30,31,32 and 33 will have to construct structures on South side of Easement.

9. The above-described property shall be used for single-family residences and one residence per lot. Duplexes, triplexes, quad-plexes and the conversion of are prohibited.

10. No portion of the land shall be used as a dumping ground for rubbish and/or trash, and the land shall be kept clean and free of any boxes, rubbish, inoperative motor vehicles, or other unsightly items incompatible with residential use.

11. No noxious or unlawful trade or activities shall be carried on upon the above-described land, nor shall anything be done thereon which may be or become a nuisance to the neighborhood.

12. Neither the residence nor any building may be used in any part for business or commercial purposes. This restriction does not preclude the reasonable use of a home office or studio to engage in literary, scholarly, artistic, professional or similar activities, including work utilizing the internet and telephone connections. These are considered an aspect of residential use. However, activities such as those in which clients, customers or employees physically come to the residence would be inconsistent with residential use and therefore constitute a prohibited business use.

13. Lots shall not be subdivided.

14. All culverts will be at least 20 feet in length and at least 15 inches in diameter, except Lots 28, 29, 30, 31 and 32 must be 20 feet in length and 18 inches in diameter and Lots 1, 2, 3, 4, 40, 39, 38, 37, and 36 must be at least 20 feet long and 12" in diameter.

15. No building or structure shall be erected within 35 foot of the front lines of any tract.

16. The lawn on each tract shall be kept mowed and kept in a neat and orderly appearance.

17. There shall be no riding of all-terrain vehicles, including but not limited to, 4-wheelers, go carts, or other off-road vehicles, on the streets of the sub-division.

18. Invalidation of any of these covenants by judgment or court order shall in no way effect any of the other covenants, which shall remain in full force and effect.

19. The use of easements as shown on the recorded plat is granted to the public and to the utility companies as set forth on the said plat for the purposes of drainage, gas, electrical, television cable and television lines. Within these easements, no structures shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities or which may change the direction of flow of easements or which may obstruct or retard the flow of water through drainage channels in the easements. The easement area of each Lot and all Improvements in it shall be maintained continuously by the owner of the Lot, except for those Improvements for which a public authority or utility company is responsible. You may fence, dig dirt, garden or cross with roads, but cannot build any kind of structures on the 280’GSU easement.

20. Storage of any type or kind of materials or products is prohibited upon all lots except that building materials may be placed or stored upon a Lot when a builder is ready to commence Improvements and then such material shall be placed within the property lines of the Lot or parcel of land upon which Improvements are to be erected and shall not be placed in the street or between the pavement or property line. No stumps, trees, underbrush or any refuse of any kind or scrap metal from the Improvements being erected on any Lot shall be placed on any adjoining Lots, streets, or easements. All such materials, if not disposed of immediately must remain on the property upon which construction is in progress, and at the completion of such Improvements, such material must be immediately removed from the property.

21. No dwelling, house or other structure shall be moved into the subdivision from within or from outside of the subdivision.

22. Permanent on the street parking is prohibited.

23. All dwellings must be on solid concrete slab. No pier and beam houses will be permitted.

24. All residential structures outside walls shall be constructed of brick, stone, or cement fiber board, such as HardiPlank. All out buildings must be neat in appearance.
